Guidelines and terms for creating Characters on MyBot.ai

Creator Agreement

Effective Date: February 18, 2026

1. Introduction

This Creator Agreement ("Agreement") supplements the Terms of Use and governs your creation and publication of AI characters ("Characters") on the MyBot.ai platform ("Platform"), operated by Helios Technologies, LLC ("Company," "we," or "us"). Terms not defined here have the meanings given in the Terms of Use.

By creating a Character on the Platform, you agree to this Agreement. If you do not agree, do not create or publish Characters. In the event of any conflict between this Agreement and the Terms of Use, the Terms of Use shall control unless this Agreement explicitly states otherwise.

IMPORTANT — ADULTS ONLY: The Platform and all content created through it are restricted to individuals who are 18 years of age or older. By agreeing to this Agreement, you confirm that you are at least 18 years old and that all Characters and Creator Content you produce are intended exclusively for adult audiences. Creating content involving or directed at minors is strictly prohibited and may result in immediate termination and referral to law enforcement.

2. What Creators Do

Creators build Characters by providing text-based content such as names, descriptions, personality definitions, backstories, greeting messages, and example dialogues (collectively, "Creator Content"). Creators may also generate images for their Characters using the Platform's built-in image generation tools. Creators may set Characters as public (accessible to all Platform users) or private (accessible only to the Creator).

3. Creator Responsibilities

In addition to the obligations in the Terms of Use, Creators agree to:

Accurate content tagging. The Platform is an adults-only service. All Characters and Creator Content are restricted to users who are 18 years of age or older. You must properly classify your Characters using the Platform's content rating system. All content must be tagged as adult (18+) by default; any content that depicts or is directed toward minors is strictly prohibited. Repeated failure to properly tag content may result in suspension or revocation of creator privileges.

Respect third-party rights. Do not create Characters that infringe on any third party's intellectual property, right of publicity, or right of privacy. This includes Characters based on copyrighted fictional characters or trademarked properties without authorization from the rights holder.

No impersonation. Do not create Characters designed to deceive users into believing they are interacting with a real person.

No circumvention. Do not attempt to bypass or manipulate Platform safety systems, including image generation constraints.

Compliance with applicable law. All Creator Content must comply with all applicable federal, state, and local laws and regulations, including but not limited to laws governing defamation, obscenity, privacy, intellectual property, and consumer protection. You are solely responsible for ensuring your Creator Content is lawful in all jurisdictions where it may be accessed.

Adults-only content requirement. The Platform is intended exclusively for adults aged 18 and older. You must not create Characters that: (a) are directed at, or designed to attract or appeal to, individuals under the age of 18; (b) depict, portray, or represent minors (individuals under 18) in any sexual, romantic, or otherwise inappropriate context; or (c) could reasonably be mistaken for content intended for minors. You must not knowingly allow or facilitate access to your Characters by anyone under the age of 18. If you become aware that a Character is being used by, targeted at, or depicting individuals under 18 in violation of this provision, you must immediately remove or reclassify the Character and notify the Company at support@mybot.ai.

4. Creator Representations and Warranties

By publishing any Character or submitting any Creator Content, you represent and warrant to the Company that:

  • You have the full legal right, power, and authority to enter into this Agreement and to grant the licenses herein.
  • Your Creator Content does not and will not infringe, misappropriate, or violate any patent, copyright, trademark, trade secret, right of publicity, right of privacy, or other intellectual property or proprietary right of any third party.
  • Your Creator Content does not and will not contain any material that is defamatory, obscene, fraudulent, deceptive, harassing, threatening, or otherwise unlawful.
  • If your Creator Content includes the name, likeness, voice, or other identifying characteristics of any real person, you have obtained all required consents and releases from that person.
  • Your Creator Content does not violate any applicable law or regulation, including laws governing export controls, privacy, and child safety.
  • You are at least 18 years of age. If you are creating content on behalf of a business entity, you have the authority to bind that entity to this Agreement and confirm that the entity's designated users are also at least 18 years of age.
  • All Creator Content you publish is intended solely for adults aged 18 and older. No Character you create depicts, portrays, or represents any individual under the age of 18 in a sexual, romantic, or otherwise inappropriate context, and no Character is designed to attract, appeal to, or be accessed by individuals under the age of 18.

These representations and warranties are made on an ongoing basis for as long as any Character you publish remains accessible on the Platform. A breach of any representation or warranty is grounds for immediate termination of your creator privileges and may give rise to the Company's indemnification rights set forth in Section 7 below.

5. Intellectual Property

5.1 Creator Ownership

You retain all ownership rights in your Creator Content.

5.2 License to Company

By publishing a Character, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and make available your Creator Content solely for the purposes of:

  • Operating and maintaining the Platform.
  • Displaying your Character and its content to other users.
  • Generating AI-driven responses when users interact with your Character.
  • Promoting the Platform (e.g., featuring Character names or descriptions in marketing materials).

Sublicensing limits: The sublicensing right granted above is limited to service providers and contractors who assist the Company in operating the Platform (e.g., hosting, CDN, and moderation vendors) and is subject to confidentiality obligations no less protective than those the Company maintains for its own proprietary information. The Company will not sublicense Creator Content to unaffiliated third parties for their independent commercial use without your separate written consent.

5.3 No AI Training

The Company will not use your Creator Content to train, fine-tune, or develop AI or machine learning models — whether our own or any third party's. Creator Content is used only to configure Character behavior within the Platform's existing AI systems at the time of interaction.

5.4 License to Other Users

When you set a Character to public, other users receive a limited, non-exclusive, non-transferable, revocable license to interact with your Character through the Platform. This does not grant them any right to copy, modify, distribute, or create derivative works from your Creator Content outside the Platform.

6. AI-Generated Responses

You acknowledge that when other users chat with your Character, the Platform's AI generates responses based on your Character's configuration. While your Creator Content influences the Character's behavior, you are not responsible for specific AI-generated outputs during other users' conversations.

Company disclaimer on AI outputs: THE PLATFORM'S AI SYSTEMS ARE PROVIDED "AS IS." THE COMPANY MAKES NO WARRANTY, EXPRESS OR IMPLIED, THAT AI-GENERATED RESPONSES WILL BE ACCURATE, APPROPRIATE, SAFE, OR FIT FOR ANY PARTICULAR PURPOSE. BECAUSE AI OUTPUTS ARE INHERENTLY UNPREDICTABLE AND PROBABILISTIC, THE COMPANY EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY HARM, LOSS, OR DAMAGE ARISING FROM AI-GENERATED CONTENT PRODUCED DURING USER INTERACTIONS WITH ANY CHARACTER ON THE PLATFORM, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THIS SECTION LIMITS THE COMPANY'S RESPONSIBILITY FOR ITS OWN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

7. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, agents, licensors, and service providers (collectively, "Indemnitees") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your Creator Content, including any claim that it infringes or misappropriates the intellectual property, privacy, or publicity rights of any third party;
  • Your breach or alleged breach of any representation, warranty, or obligation under this Agreement or the Terms of Use;
  • Your violation of any applicable law or regulation; or
  • Any claim by a third party arising from a user's interaction with a Character you published, to the extent the claim arises from your Creator Content or your failure to comply with this Agreement.

The Company will: (a) promptly notify you in writing of any claim subject to indemnification (provided that failure to notify will not relieve you of your obligations except to the extent you are materially prejudiced); (b) give you reasonable cooperation in the defense of such claim; and (c) allow you to control the defense and settlement, provided that the Company may participate at its own expense with counsel of its choice, and that no settlement that imposes any obligation or liability on the Company may be entered without the Company's prior written consent.

8. Character Removal

By you

You may delete any Character or change its visibility from public to private at any time.

Data retention on deletion: Upon deletion, cached or archived copies of your Creator Content will be removed from active Platform systems within thirty (30) days. Residual copies retained solely in backup or disaster-recovery archives will be deleted or overwritten in the ordinary course of the Company's backup rotation, which occurs no less frequently than every ninety (90) days. This retention period does not apply to copies the Company is required to retain by law or pursuant to a valid legal hold.

By us

We may remove, restrict, or reclassify any Character at any time for any reason, including violation of this Agreement or the Terms of Use, intellectual property complaints, legal requirements, or safety concerns — with or without prior notice.

Takedowns

Intellectual property takedown requests are handled under the DMCA process described in Section 10 of the Terms of Use.

9. Termination

You may terminate this Agreement by deleting all Characters and closing your account. We may suspend or revoke your creator privileges in accordance with the Terms of Use. Upon termination, the license in Section 5.2 survives only as needed to wind down display of previously published Characters and meet legal obligations.

10. Amendments

The Company reserves the right to modify this Agreement at any time. If we make material changes, we will provide at least thirty (30) days' advance notice by: (a) posting the revised Agreement on the Platform with a prominent "Updated" notice; and (b) sending an email notification to the address associated with your account. Your continued creation or publication of Characters after the effective date of the revised Agreement constitutes your acceptance of the changes. If you do not agree to the revised Agreement, you must stop publishing Characters and may terminate your account before the effective date of the changes. Non-material changes (such as typographical corrections or clarifications that do not affect your rights) may be made without prior notice.

11. General

This Agreement is governed by the Terms of Use's provisions on governing law, arbitration, indemnification, limitation of liability, severability, and waiver — all of which apply here. This Agreement, together with the Terms of Use, Privacy Policy, and Content Moderation Policy, constitutes the entire agreement regarding your creation of Characters on the Platform.
